TERMS OF SERVICE

1. Acceptance
FYXR ("the Platform") is operated by FYXR LTD, a company registered in the Abu Dhabi Global Market (ADGM) under commercial licence no. 38048, with its registered office at Desk 3701-12-D03, Office 3701, Floor 37, Sky Tower, Shams Abu Dhabi, Al Reem Island, Abu Dhabi, United Arab Emirates. By accessing or using the Platform, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
2. The Service
FYXR is a real-time creative execution network connecting buyers with curated creators. The Platform facilitates matching, checkpointed payments, and delivery of digital content.
3. User Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. The Platform reserves the right to suspend or terminate accounts that violate these terms.
4. Payments
Payments are checkpoint-based: the amount for each stage is tied to your approval of the work rather than charged all at once. During the current rollout, checkpoints are settled by invoice via bank transfer. In-platform payment processing, automatic SLA refunds, and any platform service fee are being finalized and will apply under these Terms once live.
5. Creator Terms
Creators are invited and vetted by the Platform. By accepting a job, creators agree to deliver within the specified SLA. Failure to deliver may result in payout forfeiture and potential removal from the network. All work submitted through the Platform is subject to the buyer's acceptance workflow.
6. Intellectual Property
Upon final acceptance and full payment, intellectual property rights for delivered content transfer to the buyer. Content displayed on the Platform board prior to acceptance is protected by watermarks and cannot be downloaded or reproduced.
7. Limitation of Liability
The Platform is provided "as is." FYXR is not liable for indirect, incidental, or consequential damages. Total liability is limited to the amount paid for the specific service giving rise to the claim.
8. Termination
Either party may terminate their account at any time. Active jobs with pending checkpoints will be settled according to standard payment terms before account closure. The Platform reserves the right to terminate accounts for violations of these terms.
9. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Abu Dhabi Global Market (ADGM). Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the ADGM Courts.
